FMCSA proposes to make English language proficiency violations an out-of-service offense. This change would align federal regulations with current enforcement standards used by the Commercial Vehicle Safety Alliance. The agency aims to ensure uniform enforcement across the United States and Canada.

Under the proposal, a driver who cannot meet the English proficiency requirement would be placed out of service. This applies to drivers operating in the United States. An exception exists for trips that do not involve transportation outside of U.S.-Mexico border commercial zones.

The rulemaking responds to a petition from the Commercial Vehicle Safety Alliance. It codifies what is currently an enforcement tolerance into formal regulation. FMCSA estimates the change will cost motor carriers approximately $14.4 million annually.

Members can submit comments on the proposal. Comments must be received on or before October 9, 2026. Submissions should include Docket No. FMCSA-2026-0826. Comments can be sent online, by mail, or by fax.
